The Honorable Douglas W. Hillman, Senior District
Judge denied a motion filed on behalf of Governor
John M. Engler to compel compliance with the
gaming revenue disbursement the tribes were
required to pay to the State of Michigan as
stated in the Tribal/State Gaming Compact. The
Tribes exclusive right to operate ceased
being exclusive when that right was extended
and became effective for the newly recognized
tribes. This decision was the most appropriate
action the courts could have taken. Although
8% of gaming revenue will no longer be paid
to the State of Michigan, a 2% revenue will
continue to be distributed to local governments.
Tribal Council is delaying any plan for the
monies that have been held during the period
between February and July of 1999 in expectation
of an appeal from the State of Michigan.
